The module aims to explore and teach essential aspects of contractual law in the EU context, analysing interactions between harmonisation, history and the influence of models through comparison and cross-fertilisation. HCLEU explores how the cross-fertilisation of legal knowledge can influence the rights and duties of EU citizens as parties to contracts and subjects of ensuing legal rights and duties.
The Module considers how select national legislation tries to implement innovative models for contract law and how outcomes are implemented in others countries. More specifically, HCLEU explores new models for obligations and contracts following already established or prospective reforms, including Belgium, France, Italy, Luxemburg and Spain. The module contextualises the analysis in a comparative framework, covering essential regulatory areas, notably (1) formation of contracts; (2) object of contract; and (3) contractual remedies.
Students and participants will therefore be enabled to develop a critical stance on questions relating to the EU and the rights and obligations that EU citizens have when contracting in EU member states.
